Welcome to Focus Flow! These Terms of Service ("Terms") govern your use of the Focus Flow platform and services. By using Focus Flow, you agree to these Terms.
Please read these Terms carefully before using our services. If you do not agree to these Terms, please do not use Focus Flow.

Definitions
"Focus Flow" refers to the photography studio management platform, including the website, applications, and all related services.
"User" or "You" refers to the individual or entity using Focus Flow.
"Services" refers to all features and functionality provided by Focus Flow.
"Content" refers to any data, text, images, or other materials uploaded to Focus Flow.
"Client Data" refers to personal data of your clients that you manage through Focus Flow.

Focus Flow provides:
Client relationship management (CRM)
Booking and calendar management
Contract and document management
Invoicing and payment collection
Photo gallery hosting and delivery
Workflow automation
Email and communication tools
We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice.

Your Account
Registration
You must be at least 18 years old to use Focus Flow
You must provide accurate and complete registration information
You are responsible for maintaining the security of your account credentials
Account Security
You are responsible for all activity under your account
Notify us immediately if you suspect unauthorized access
We recommend enabling two-factor authentication

Acceptable Use
You agree NOT to:
Use Focus Flow for any illegal purpose
Upload content that infringes intellectual property rights
Upload malware, viruses, or harmful code
Attempt to gain unauthorized access to our systems
Use Focus Flow to send spam or unsolicited communications
Resell or redistribute Focus Flow without authorization
Violate the privacy rights of others
Upload content that is obscene, defamatory, or harmful
Violation of these rules may result in immediate termination of your account.

Your Content
Ownership
You retain all ownership rights to the content you upload to Focus Flow. We do not claim ownership of your photos, documents, or client data.
License to Focus Flow
By uploading content, you grant Focus Flow a limited license to store, process, and display your content solely for the purpose of providing our Services to you.
Your Responsibility
You are responsible for obtaining necessary rights to content you upload
You must have consent from individuals appearing in photos
You must comply with applicable laws regarding client data

Data Processing Agreement (DPA)
DPA Overview
This section constitutes a Data Processing Agreement between you (the "Controller") and Focus Flow (the "Processor") regarding the processing of your clients' personal data ("Client Data").
6.1 Roles
You are the Data Controller for your clients' personal data
Focus Flow is the Data Processor acting on your behalf
6.2 Processing Purpose
Focus Flow processes Client Data solely to:
Provide the Services as described in these Terms
Follow your documented instructions
Comply with applicable laws
6.3 Our Obligations
Focus Flow agrees to:
Process Client Data only on your documented instructions
Ensure personnel are bound by confidentiality obligations
Implement appropriate technical and organizational security measures
Assist you in responding to data subject requests
Delete or return Client Data upon termination (subject to legal retention requirements)
Make available information necessary to demonstrate compliance
Notify you of any data breaches without undue delay
6.4 Sub-processors
Focus Flow uses the following sub-processors. By agreeing to these Terms, you authorize our use of these sub-processors:

6.5 International Transfers
When Client Data is transferred outside the EEA, we ensure compliance through Standard Contractual Clauses (SCCs) or adequacy decisions.
6.6 Your Obligations
As the Controller, you must:
Have a lawful basis for processing your clients' data
Provide appropriate privacy notices to your clients
Respond to data subject requests from your clients
Ensure instructions to Focus Flow comply with applicable laws

Payments & Subscriptions
Subscription Plans
Focus Flow offers various subscription plans with different features
Prices are displayed excluding VAT where applicable
We reserve the right to change prices with 30 days notice
Billing
Subscriptions are billed in advance (monthly or annually)
Payment is processed securely through Stripe
Failed payments may result in service suspension
Refunds
Monthly subscriptions: No refunds for partial months
Annual subscriptions: Pro-rated refund within first 30 days
Contact support for refund requests
Free Trial
Trial periods do not require payment information
All features are available during the trial
No automatic charges after trial ends

Intellectual Property
Focus Flow and its original content, features, and functionality are owned by Focus Flow and are protected by international copyright, trademark, and other intellectual property laws.
The Focus Flow name, logo, and all related names and logos are trademarks of Focus Flow. You may not use these without our prior written permission.

Beta Program
Beta Notice
Focus Flow is currently in beta. By using our services during the beta period, you acknowledge and agree that:
The service is under active development and may contain occasional bugs or incomplete features
Features may be added, modified, or removed as we improve the platform
The beta period pricing (including any free tier) may change when the service reaches general availability
Your data is protected by automatic backups on EU-based infrastructure. We take security and reliability seriously, even during the beta period. We encourage beta users to report any issues or share feedback to help us improve the platform. Beta users who actively contribute may be eligible for special pricing when the service launches publicly.

Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Focus Flow is provided "as is" and "as available" without warranties of any kind, express or implied
We do not warrant that the service will be uninterrupted or error-free
We are not liable for any indirect, incidental, or consequential damages
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
During the beta period, this limitation applies with particular emphasis given the nature of beta software
Some jurisdictions do not allow these limitations, so they may not apply to you.

Termination
By You
You may cancel your subscription and delete your account at any time from your account settings.
By Focus Flow
We may terminate or suspend your account if:
You violate these Terms
Your use poses a security risk
Required by law
Your account has been inactive for 12+ months (free accounts)
Effect of Termination
You will have 30 days to export your data
After 30 days, we may delete your data
Financial records are retained as required by law

Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
Email notification to your registered email address
In-app notification
Posting on this page with an updated effective date
Continued use of Focus Flow after changes constitutes acceptance of the new Terms.

Governing Law
These Terms are governed by the laws of Italy. Focus Flow is a product of Stefan Blejeru Photography (P.IVA 15392121008), with registered office at Via Casilina 1879, 00132 Roma, Italy. Any disputes shall be resolved in the courts of Rome, Italy, unless you are a consumer entitled to protection under the laws of your country of residence.
For EU consumers: You may also be entitled to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
